At TML Logistics CR (“TM&L”) we take the protection of your personal data seriously. This policy explains what information we collect when you visit tmlcenac.com, how we use it, and what rights you have over it, in compliance with Costa Rica Law N° 8968 on the Protection of Persons against the Processing of their Personal Data.

1. Data controller

The controller responsible for processing your data is TML Logistics CR, located at Santa Ana Town Center, Piso 2 Edificio A, Santa Ana, San José, Costa Rica. For any questions about this policy or to exercise your rights, you can write to operaciones.cr@tmlogistic.net.

2. Data we collect

2.1 Data you provide

  • Contact form: name, company, email, phone, sector, request type, required capacity, and message.
  • Direct communications: emails, WhatsApp messages, or calls you initiate.

2.2 Data collected automatically

  • Navigation data: IP address, browser type, operating system, pages visited, time on site, language, and referrer.
  • Cookies and similar technologies: see section 6.

3. Purposes of processing

  • To respond to your information, quote, or technical support requests.
  • To operate and manage our commercial relationship.
  • To comply with legal, tax, or regulatory obligations.
  • To send commercial communications about TM&L products and services when you have given explicit consent or when there is a legitimate interest.
  • To improve site experience and measure performance in aggregate.

4. Legal basis

  • Your informed consent, given by submitting the form or accepting cookies.
  • Performance of a contract or pre-contractual measures, when applicable.
  • TM&L’s legitimate interest in responding to inquiries and protecting site security.
  • Compliance with applicable legal obligations.

5. Who we share your data with

TM&L does not sell your data. We share it only with providers that help us operate the site:

  • Vercel Inc. (United States) — site hosting.
  • Resend Inc. (United States) — transactional email delivery.
  • Meta Platforms, Inc. — ad measurement and remarketing (only if you accept cookies).
  • Google LLC — site analytics (only if you accept cookies).
  • Pura Vida Growth S.A. — agency operating the site and managing marketing communications on behalf of TM&L.

6. Cookies

  • Strictly necessary: enable basic site functionality. No consent required.
  • Analytics: help us understand site usage (Google Analytics, if active).
  • Marketing: enable ad campaign measurement and relevant ads (Meta Pixel).

Analytics and marketing cookies only load after you accept the cookie notice. You can change your choice by clearing your browser cookies or local storage for this site.

7. Retention period

We retain contact form data for a maximum of 3 years from the last commercial interaction, unless a legal obligation requires us to keep it longer or you request its deletion.

8. Your rights

Under Law 8968 you have the right to:

  • Access the personal data we hold about you.
  • Rectify it if outdated or inaccurate.
  • Request its deletion when no longer necessary.
  • Object to processing or withdraw consent.
  • File a complaint with the Costa Rica Data Protection Agency (PRODHAB) at prodhab.go.cr.

To exercise any of these rights, write to operaciones.cr@tmlogistic.net. We respond within 30 calendar days.

9. Security

We apply reasonable technical and organizational measures to protect your data against loss, unauthorized access, alteration, or disclosure. The site uses HTTPS and data in transit is encrypted. No system is 100% secure.

10. International transfers

Some of our providers have servers outside Costa Rica, mainly in the United States. These transfers are made under contractual clauses and equivalent protection standards required by Costa Rican legislation.

11. Changes to this policy

We may update this policy. When we do, we will modify the “Last updated” date at the top. For substantial changes, we will notify you via email or a prominent notice on the site.
