Terms and Conditions

These terms govern access to and use of the website tmlcenac.com (the “Site”), owned by TML Logistics CR (“TM&L”). By accessing the Site, you agree to comply with these terms.

1. Purpose of the site

The Site is informational and commercial. It presents TM&L’s product and service catalog (industrial generator rental, technical support, maintenance, and parts procurement) and allows visitors to request commercial information. The Site does not constitute a binding offer: any engagement is formalized through a separate written contract.

2. Permitted use

• Provide truthful information when completing forms.
• Do not use the Site for unlawful, fraudulent, or harmful purposes.
• Do not attempt to access restricted areas or disrupt the Site.
• Respect the intellectual property rights described in section 5.

3. Site availability

TM&L makes reasonable efforts to keep the Site available 24/7 but does not guarantee uninterrupted or error-free operation. We may suspend access for maintenance, updates, or force majeure without prior notice.

4. Product information and pricing

Technical specifications, kVA capacities, images, and product descriptions are for reference only. Exact equipment characteristics, availability, and final prices are confirmed in the formal quote issued by TM&L upon receiving a request. Prices shown (when applicable) do not include taxes, transport, or installation unless expressly stated.

5. Intellectual property

All Site content (texts, photographs, logos, graphics, code, illustrations, and design) is the property of TM&L or used under license. It is protected by Costa Rican and international intellectual property law. Reproduction, distribution, modification, or commercial use without TM&L’s written authorization is prohibited. Manufacturer trademarks mentioned (Cummins, Volvo Penta, Yanmar, Perkins, Atlas Copco, among others) are property of their respective owners.

6. External links

The Site may contain links to third-party sites. TM&L does not control or take responsibility for the content, privacy policies, or practices of those sites.

7. Limitation of liability

To the fullest extent permitted by law, TM&L shall not be liable for indirect, incidental, or consequential damages arising from the use of or inability to access the Site. TM&L’s total liability related to the Site shall not exceed the amount actually paid by the user for TM&L services in the twelve months preceding the event giving rise to the claim, if any.

8. Data protection

Processing of personal data collected through the Site is governed by the Privacy Policy, which forms an integral part of these terms.

9. Modifications

TM&L may modify these terms at any time. Changes take effect upon publication on the Site. Continued use of the Site after publication constitutes acceptance.

10. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Costa Rica. Any dispute relating to the Site shall be submitted to the competent courts of San José, Costa Rica.
